Semi-Truck Driver Killed Following Collision with Excavator

A truck driver is dead and another is injured following a multiple-vehicle crash that occurred along Interstate 95. According to Space Coast Daily, the driver thought to be at fault in the incident was transported to a nearby hospital following the accident, while the driver of the other truck involved was pronounced dead at the scene.

Details released by the Florida Highway Patrol reveal that one truck driver, who was traveling northbound, was killed after being struck by an excavator that became detached from a semi that had been traveling in the highway’s southbound lanes. The detachment occurred after the truck driver struck a guardrail, which caused the excavator to fly off and land in the opposite lanes. It is believed that two other motorists were struck by flying debris as a result of the crash, though neither party suffered serious injury. A tire tread separation is thought to be the primary cause of the crash.

Family Questions Role of Semi Truck Driver in Fatal Crash

In the wake of a three-vehicle accident that claimed one driver’s life, the victim’s surviving family members are questioning the role of a semi-truck driver who was allegedly involved in the collision. KSDK News reports that the accident, which occurred on I-270 in Missouri, began when the semi-truck moved into victim’s driving lane. The victim’s car subsequently collided with a third vehicle, and the two passenger cars then struck a median. Tragically, the victim sustained catastrophic injuries when he was thrown from his vehicle.

The semi-truck driver left the scene of the accident without stopping but later contacted law enforcement authorities. Report: Second Serious Accident Involving a FedEx Truck in Sacramento in Five Months

Authorities are reportedly pressing charges of driving under the influence against a FedEx truck driver who allegedly injured a California Highway Patrol officer during an early-morning accident near Sacramento. The officer was working on a Highway 50 off-ramp at the scene of a hit-and-run crash in May 2016, when the truck driver allegedly struck him at around 3:30 a.m., according to The Sacramento Bee. Authorities have not determined whether the truck directly hit the officer or struck him after colliding with the man’s patrol vehicle.

Alarmingly, this is the second serious accident involving a FedEx truck driver to occur in recent months in Sacramento. In December, a motorist died when a FedEx driver crossed into oncoming traffic after losing control of his truck due to inclement weather conditions. Fortunately, the officer who was injured in the most recent accident is expected to survive, even though he reportedly suffered major injuries during the crash, the website reported.

Criminal Liability for Drunk Driving Accidents is Different Than Civil Liability

Regardless of the outcome of any criminal action against the driver, the determination of the criminal court is different than any civil case that may be brought against the driver. In a criminal matter, a person is accused of a crime and, if convicted, can be sentenced to jail or probation. Sometimes monetary fines and restitution are imposed on the guilty party.

However, the outcome of a criminal matter is often not relevant to a civil matter that could be brought against the person committing the wrongful act. A person who drives drunk commits a crime, but if that person also injures or kills another person while driving drunk, he or she may face civil liability in addition to criminal charges.

In a civil case, a person’s actions are not judged on whether they were illegal, but instead on whether they constituted negligence, reckless or malicious behavior, or other fault. If those actions are found to constitute fault, and if those actions caused injury to another person, then the wrongful actor may be held liable to the injured party for the payment of money to compensate for the injuries and other damages caused.

Report: Truck Driver Was Driving Despite Having a Revoked License

A truck driver who was involved in a multicar crash that claimed two lives in Maine in March 2016 made his first appearance in court, where he faced charges of manslaughter as well as aggravated driving under the influence. The Bangor Daily News reports that the tragic accident occurred when the trucker allegedly drifted across the center line and into an oncoming traffic lane. The semi collided with two vehicles, causing fatal injuries to both drivers, before hitting a third car. The driver of the third vehicle, which rolled over and subsequently struck a fourth vehicle, was transported to a local hospital with injuries.

According to officials, blood testing performed at the scene of the crash indicated that the driver’s blood alcohol concentration level was above the legal limit and at more than twice the legal limit for commercial drivers. The trucker, who was reportedly driving despite the revocation of his license, also admitted to taking hydrocodone, an opioid pain medicine. Data from the semi truck’s engine control module indicates that the trucker was traveling more than 15 miles per hour over the speed limit when the accident occurred, the website reported.

Claim: At Fault Semi Driver Was Distracted by Cell Phone

A lawsuit filed in March 2016, alleges that an Indiana commercial carrier and one of its drivers were at fault in a head-on tractor trailer crash that caused another truck driver severe injuries. The Madison Record reports that this plaintiff is now seeking compensation for the medical costs resulting from the injuries he suffered, which include fractures, lacerations, sprains and emotional distress. The man’s wife also is seeking damages for loss of consortium.

The lawsuit alleges that the accident occurred as a result of various negligent actions on the part of the other tractor trailer driver. Wife Claims Three Companies and Two Truck Drivers To Blame in Her Husband’s Death

A wrongful death lawsuit filed in connection with the December 2014 death of a Florida motorist alleges a commercial truck driver was negligent in operating a truck with defective tail lights and turn signals, among other allegations, according to News 4 Jacksonville. The widow of the accident victim has filed suit against multiple parties in connection with the deadly hit-and-run, and she seeks compensation for funeral expenses, emotional pain and other damages in excess of $75,000 from each defendant.

The accident victim’s vehicle became disabled after he collided with a tractor trailer that was traveling between 45 and 50 mph under the posted speed limit. The driver of the tractor trailer kept going, and the victim was then struck and killed by another commercial truck. Attorneys for the plaintiff allege that the driver of the initial truck had exceeded the number of hours he was allowed on the road. The lawsuit also claims that the driver was aware the truck had problems because he had to pull over twice before, and that the driver continued to operate the truck despite the fact that it was billowing smoke. The lawsuit was filed against the truck driver and the companies that owned the truck. It also names the driver of the second truck that hit the victim’s vehicle and the company that owned it, the website reported.

Tractor Trailer Accident Attorney Notes Semi Driver Crossed Median, Stuck Multiple Vehicles

Authorities believe that a seven-vehicle accident that occurred in Norfolk, Virginia on January 9, 2016, might be attributable to a medical condition of one of the involved drivers. WAVY News reports that the multi-vehicle crash began when a tractor trailer allegedly crossed a median and struck two approaching vehicles. Four other vehicles were ultimately involved in the tractor trailer accident, and multiple people reported minor injuries.

First responders found that the 67-year-old truck driver was unresponsive after the accident, and he was later pronounced dead at a local hospital. The cause of the accident and the cause of the driver’s death have not been officially determined. However, authorities have suggested that the semi truck driver may have suffered from a medical condition, which could have caused him to lose control of the vehicle or played some other role in the accident. The Office of the Chief Medical Examiner will determine the exact cause of his death, the news agency reported.
