Accident Reportedly Occurred in Area Known for Heavy Bicycle Traffic

A lawsuit filed in Cook County, Illinois, alleges that a truck driver and his employer are liable for a deadly accident that claimed the life of a female bicyclist in July 2015. According to The Chicago Tribune, the woman was using a ride-sharing bicycle and traveling in a northbound lane when a big rig that was moving in the same direction executed a right-hand turn, causing the two vehicles to collide. This tragic accident reportedly represents the first known fatality involving a commuter who was using a shared bicycle.

The family’s lawsuit contends that the trucker was negligent for failing to reduce his speed, maintain awareness of other road users or yield the right of way. The family’s attorney notes that the accident occurred in an area that is known to experience heavy bicycle traffic. Still, the truck driver apparently failed to monitor his surroundings for bicyclists.

Semi-Truck Driver Killed Following Collision with Excavator

A truck driver is dead and another is injured following a multiple-vehicle crash that occurred along Interstate 95. According to Space Coast Daily, the driver thought to be at fault in the incident was transported to a nearby hospital following the accident, while the driver of the other truck involved was pronounced dead at the scene.

Details released by the Florida Highway Patrol reveal that one truck driver, who was traveling northbound, was killed after being struck by an excavator that became detached from a semi that had been traveling in the highway’s southbound lanes. The detachment occurred after the truck driver struck a guardrail, which caused the excavator to fly off and land in the opposite lanes. It is believed that two other motorists were struck by flying debris as a result of the crash, though neither party suffered serious injury. A tire tread separation is thought to be the primary cause of the crash.

Early Reports Suggest Big Rig Driver May Have Lost Control

A multivehicle accident on Interstate 30 claimed the lives of all three drivers involved. Fox News reports that the accident occurred in the early morning hours, when a semi-truck and a passenger vehicle that were traveling on the interstate crossed over the median and into the path of a second semi-truck. Authorities haven’t yet determined who was at fault, and they are still in the process of investigating the crash, which was catastrophic enough to shut down the interstate for over 12 hours.

Early reports indicate that the driver of the first semi-truck, which was traveling on westbound I-30 just before the accident occurred, lost control of his big rig and drifted to the left. This caused the semi to collide with the passenger vehicle and push it toward the median. After the highway cable guards apparently failed, the big rig and the passenger car both crossed over onto eastbound I-30, where they collided with the other semi-truck.

Family Questions Role of Semi Truck Driver in Fatal Crash

In the wake of a three-vehicle accident that claimed one driver’s life, the victim’s surviving family members are questioning the role of a semi-truck driver who was allegedly involved in the collision. KSDK News reports that the accident, which occurred on I-270 in Missouri, began when the semi-truck moved into victim’s driving lane. The victim’s car subsequently collided with a third vehicle, and the two passenger cars then struck a median. Tragically, the victim sustained catastrophic injuries when he was thrown from his vehicle.

The semi-truck driver left the scene of the accident without stopping but later contacted law enforcement authorities. His role in the accident has not yet been reported to the victim’s family members. Additionally, authorities are still determining whether they will file charges against the driver for his alleged role in the accident or his decision to flee the scene.

Report: Second Serious Accident Involving a FedEx Truck in Sacramento in Five Months

Authorities are reportedly pressing charges of driving under the influence against a FedEx truck driver who allegedly injured a California Highway Patrol officer during an early-morning accident near Sacramento. The officer was working on a Highway 50 off-ramp at the scene of a hit-and-run crash in May 2016, when the truck driver allegedly struck him at around 3:30 a.m., according to The Sacramento Bee. Authorities have not determined whether the truck directly hit the officer or struck him after colliding with the man’s patrol vehicle.

Alarmingly, this is the second serious accident involving a FedEx truck driver to occur in recent months in Sacramento. In December, a motorist died when a FedEx driver crossed into oncoming traffic after losing control of his truck due to inclement weather conditions. Fortunately, the officer who was injured in the most recent accident is expected to survive, even though he reportedly suffered major injuries during the crash, the website reported.

Criminal Liability for Drunk Driving Accidents is Different Than Civil Liability

Regardless of the outcome of any criminal action against the driver, the determination of the criminal court is different than any civil case that may be brought against the driver. In a criminal matter, a person is accused of a crime and, if convicted, can be sentenced to jail or probation. Sometimes monetary fines and restitution are imposed on the guilty party.

However, the outcome of a criminal matter is often not relevant to a civil matter that could be brought against the person committing the wrongful act. A person who drives drunk commits a crime, but if that person also injures or kills another person while driving drunk, he or she may face civil liability in addition to criminal charges.

In a civil case, a person’s actions are not judged on whether they were illegal, but instead on whether they constituted negligence, reckless or malicious behavior, or other fault. If those actions are found to constitute fault, and if those actions caused injury to another person, then the wrongful actor may be held liable to the injured party for the payment of money to compensate for the injuries and other damages caused.

Report: Truck Driver Was Driving Despite Having a Revoked License

A truck driver who was involved in a multicar crash that claimed two lives in Maine in March 2016 made his first appearance in court, where he faced charges of manslaughter as well as aggravated driving under the influence. The Bangor Daily News reports that the tragic accident occurred when the trucker allegedly drifted across the center line and into an oncoming traffic lane. The semi collided with two vehicles, causing fatal injuries to both drivers, before hitting a third car. The driver of the third vehicle, which rolled over and subsequently struck a fourth vehicle, was transported to a local hospital with injuries.

According to officials, blood testing performed at the scene of the crash indicated that the driver’s blood alcohol concentration level was above the legal limit and at more than twice the legal limit for commercial drivers. The trucker, who was reportedly driving despite the revocation of his license, also admitted to taking hydrocodone, an opioid pain medicine. Data from the semi truck’s engine control module indicates that the trucker was traveling more than 15 miles per hour over the speed limit when the accident occurred, the website reported.
