I-94 Indiana Semi Accident Raises Questions About Blame in Winter Weather

Indiana Semi AccidentIndiana Semi Accident

I-94 East became the scene of a massive Indiana semi accident on January 23rd, 2014. The fierce winter weather that had been pounding the country for weeks set the stage for tragedy as heavy lake effect snow created near white out conditions. It was reported that I-94, a connecting highway between Chicago and Detroit, was slicked over in ice at the time of the accident.

“It went from sunshine to complete no visibility, so when they entered in, it turned into slide off, crash, crash,” said Indiana Police Sgt. Ann Wojas. By the time all was said and done, 46 vehicles including 18 semis were involved in the Indiana semi accident.

The Difficulty of Legal Liability

Even though weather played such a serious role in the Indiana semi accident, there is a significant problem: § 392.14 of the Federal Motor Carrier Safety Regulations (FMCSRs). When hazardous conditions exist, “[e]xtreme caution in the operation of a commercial motor vehicle shall be exercised.” It goes on to state that “[i]f the conditions become sufficiently dangerous, the operation of the commercial motor vehicle shall be discontinued and shall not be resumed until the commercial motor vehicle can be safely operated.” The only exceptions that exist to the FMCSRs are in the case of stricter terms outlined by state regulations.

Some auto accident lawyers have speculated that the Indiana semi accident should not actually have involved any semis at all. It is no secret that accidents with semi trucks increase in bad weather conditions. The circumstances do not get much more unsafe than iced over roads, white out conditions, with tens of thousands of pounds of cargo loaded in the trailer.

Then comes the question of liability and pursuit of compensation by an auto accident lawyer. It is an unfortunate set of circumstances involving winter weather that started off the Indiana semi accident; and some people involved believe those semis probably should not have been on the road. The people affected in this accident could have a case if they take the matter up with an auto accident lawyer to pursue damages against the semi drivers or their parent companies. An auto accident lawyer can analyze the situation, help determine who was at fault, and pursue compensation for damages if appropriate. Victims may have immediate injuries that will impact their quality of life, incur medical experiences, result in lost income, and experience pain and suffering. Winter weather does not always excuse blame in a winter weather accident.

Fire Chief Mick Pawlik of the Coolspring Volunteer Fire Department was reported as saying in regards to the massive Indiana semi accident, “it was such a devastating scene. It’ll live with us forever.”

A statement from a first responder at the accident stated that the people that actually experienced the trauma without physical injury may face Post-Traumatic Stress Disorder which can and does manifest after such circumstances. Those people should be speaking to an auto accident lawyer as well to ensure their story is cataloged and represented if legal action becomes necessary.

Semi Truck Accident Lawyer Notes Semi Driver With 2 Dozen Infractions Involved in Fatal Wreck

Semi Truck Accident LawyerIn the early morning hours of February 12th, 2014, an ABC Fine Wine & Spirits semitrailer clipped the rear of a BMW as it pulled out to pass while going southbound on I-75. The collision caused the semi to roll over on the I-75 bridge that spans the Alafia River. The BMW was sent off the road between the north and southbound lanes and into the five-foot deep river. The driver of the car perished as a result.

The driver of the semitrailer truck suffered only minor injuries. An initial investigation revealed that the driver had over two dozen driving infractions on his record in the past 10 years. His driver’s license has been suspended six times. The standards for a Commercial Driver’s License (CDL) only take some of those infractions into account. Of the two dozen, only two actually apply towards the CDL and both are non-moving infractions.

Florida does not bar individuals from getting a CDL based on their past driving record. The driver must have a valid operator’s license and pass the written and vehicle skills tests. The Florida Highway Patrol is investigating if citations should be issued.

The Necessity Of A Semi Truck Accident Lawyer

Situations such as this highlight the need for representation from an experienced semi truck accident lawyer. There are many underlying lines of information that need to be explored for preservation of evidence in building a civil case. And just because there are criminal charges involved, that does not mean a civil case cannot be pursued. The victims of such a collision are not likely to be of sound mental and emotional state at a time when they need it most. The victims may be too embroiled in grieving or worrying about present medical circumstances to fully investigate all of the necessary information that can help support their claim.

Driver fatigue is commonplace in the industry. Employers put a heavy demand on drivers to get their loads hauled ahead of schedule to minimize employee and road expenses. Regular maintenance can also be a serious issue for less scrupulous businesses. Skimping on maintenance to curb costs can result in a semi truck that is not entirely responsive to the driver. Accidents can occur due to mechanical failure regardless of the skill of the driver behind the wheel.

A final major factor is the drivers themselves. A semi truck accident lawyer can look into the history and actions of the driver in operation of the truck. Negligent actions, distractions, driving under the influence- all can distract the driver from the road and the job they are supposed to be doing with a several ton machine in a public place. These are circumstances that all need to be analyzed by a semi truck accident lawyer.

Recent Devastating Truck Accidents

The driver of a semi truck hauling mail was killed on I-70 near Deer Trail, Colorado on January 15, 2014 when the vehicle drifted off the side of the highway and crashed into a guardrail. The accident prompted an investigation that shut down the highway for most of the morning, and Colorado highway police confirmed that the man was the only individual involved in the crash. Traffic was shut down as crews continued to clean up a fuel spill and to repair a bridge that had been damaged by the crash.

On January 18, 2014, in Lafayette, Indiana, a fiery crash shut down I-65 and left drivers stranded for hours. According to Indiana State Police, a semi truck had slowed down due to a crash occurring in front of him. However, the semi trucks behind him did not brake in time, possibly because they were following too close or traveling too fast for the adverse weather conditions. A total of four cars and nine semi trucks were involved in the first crash, one truck which caught on fire, and other accidents occurred behind those. Emergency responders had difficulty reaching the scene, as there were cars on fire in every lane of the highway.

Importance of Truck Accident Attorneys

Due to the sheer size and weight difference between semi trucks and passenger vehicles, accidents caused by commercial trucks can cause significant and often catastrophic damages. It is important to seek legal counsel from truck accident attorneys, particularly because more than one party may be held responsible for the incident. For example, while the driver may have acted out of negligence and was driving while distracted, under the influence or speeding, those injured may also be eligible to hold the driver’s employer, the owner of the truck, the truck’s service company or other parties accountable, depending on the cause of the accident.

It is also important to document every aspect of the accident and obtain contact information from witnesses and the parties involved. File a police report as this may serve as evidence should you decide to proceed and start a claim. Truck accident attorneys understand the difference in liability and the complex laws surrounding trucking accidents and can help victims file for the compensation to which they may be entitled such as vehicular damages, lost wages, medical expenses, loss of earning capacity, mental anguish and pain and suffering.

Fatal Accident Causes Two Fatalities

On January 10, 2014, a semi truck driver was arrested in a hit-and-run accident that injured five people and killed two others near the border between Arizona and California, according to authorities. The man was booked in jail on suspicion of five counts of aggravated assault, two counts of second-degree murder, criminal damage, leaving the scene of a fatal collision and driving under the influence of drugs.

Deputies arrested the driver on Interstate 10 westbound, 20 miles east of Quartzsite, half a mile from the site of the accident. According to authorities, the driver fled from the truck after the rear-end collision occurred that had resulted in a Ford Expedition veering off the highway and rolling over at least one time.

Seven people were traveling in the Expedition, and two passengers were ejected from the vehicle and killed. An eight-year-old boy and four-year-old girl sustained serious injuries, and a 74-year-old man, 33-year-old woman and seven-year-old boy all received minor-to-moderate injuries.

According to the Arizona Department of Transportation, the westbound lanes of Interstate 10 were closed for roughly 12 hours; eastbound lanes were not affected by the accident.

Importance of Working with Semi Truck Collision Attorneys

No matter the severity of the crash, accidents involving semi trucks can be life-changing and catastrophic. Unfortunately, children and adults alike are at risk of being involved in such incidents, and the potential for devastating injuries is high. Common causes of semi truck accidents include:

  • Faulty brakes
  • Loads that shift weight
  • Overloaded trailers or trucks
  • Aggressive driving
  • Hazardous roads
  • Improper maintenance
  • Driver fatigue
  • Driving under the influence
  • Jacknives, head-on or rear-end collisions
  • Tread burn or tire blowouts

Although there are federal regulations and laws that govern the trucking industry and attention to detail and simple care may prevent many accidents from occurring, often the potential for profits determine the decisions that lead to sleep deprivation and driver fatigue. With unrealistic expectations and schedules of trucking companies, some drivers may be pushed beyond their limits, despite the important safety risks involved. For this reason, victims may consider working with semi truck collision attorneys to determine who should be held accountable for the accident. While it is important to remember the importance of documenting every aspect of the accident prior to speaking with an attorney, semi truck collision attorneys can still inform you of your legal rights and help you to seek compensation for damages for the incident.

Any Case Involving A Semi Truck Collision May Be Actionable

A strange case occurred recently between a semi truck and an Amtrak passenger train in Kirkwood. A passenger train bound from St. Louis to Kansas City collided with a semi truck stuck at a crossing on January 7th, 2014. The semi became bogged down and stuck at the crossing thanks to the severe winter weather that much of the country was experiencing at the time. A build up of snow and ice left the driver unable to free the truck from its position across the tracks.

The passenger train carried 59 total passengers and crew members. There were no fatalities in the accident, but two passengers were moderately injured because of the collision. These are the kind of strange circumstances that warrant a closer look at the situation by a semi truck collision lawyer. It really does not matter how things look on the surface and how much of an accident something may seem; there may still be an actionable case. It’s better to consult with a semi truck collision lawyer who can examine the case for negligent actions or activities that would create a liability.

The two people injured in that accident may face medical bills and lost wages as a result of the collision.

Truck Accident Lawyers Discuss: Semi Driver Gets 20 Years For Vehicular Homicide

Truck Accident LawyerSemi truck accidents due to distracted or careless driving can be devastating not only to those directly involved but also to family members and friends as well. Distracted drivers may turn their attention away from the roadway for any number of reasons, many of which endanger themselves and pedestrians, passengers and other drivers. Additionally, while distracted driving can be dangerous for anyone in a motor vehicle, it can be even more deadly for those operating larger commercial vehicles due to the extreme size difference between semi trucks and traditional passenger cars.

If you or a loved one have been injured, you may wish to seek legal counsel from a truck accident lawyer to learn more about your rights. You may be eligible to file for compensation and recover damages including lost wages, medical expenses and pain and suffering, although your truck accident lawyer will help to determine to what you are entitled based on your situation.

Truck Driver Sentenced to 20 Years

On October 16, 2013, a 37-year-old truck driver from Illinois was sentenced to 20 years in prison after allegedly causing an accident in western Nebraska that killed a family. According to the man’s truck accident lawyer, the driver put forth a “no contest” plea to one count of vehicular homicide concerning an unborn child and to four counts of vehicular homicide. Four manslaughter counts were subsequently dropped by prosecutors.

Traveling nonstop from Milwaukee, the man allegedly fell asleep at the wheel, causing the fatal accident on September 9, 2012. His semi truck hit the back of a car killing a man, his pregnant wife, and their two children, ages two and three.

Careless Driving Causes Devastating Consequences

According to statistics, over 3,000 people are killed in accidents involving careless driving every year. Careless driving may include drunk driving or driving under the influence, distracted driving or other situations when a driver’s attention may not be fully focused on the road. Unfortunately, those operating large semi trucks may cause greater damage if they are not paying attention due to the sheer size and weight of the vehicle and cargo.

In Phoenix, Arizona, a driver was charged with second-degree murder after authorities found that he had been looking at photographs of scantily clad women on Facebook while his vehicle was set in cruise control at 65 miles per hour. His semi truck slammed into two fire department trucks, three police cars and killed one public safety officer. The man had also allegedly been viewing porn sites, female escort pages, YouTube and social networking sites while operating his truck.

Not only does careless driving contribute to collisions, but many drivers also operate under extreme fatigue as well. Whether their employers are on a strict, unrealistic schedule or drivers feel forced to race to destinations without taking the legal break to which they are required, driver fatigue can be disastrous. By law, drivers are required to take breaks and pull off of the road for specified periods of time in order to rest their eyes, stretch and gather themselves for the next part of their travels. By failing to take these breaks and push themselves to the limit, drivers may be at a higher risk for causing accidents due to fatigue or exhaustion.
